• Create an account and register your product on the website http://www.portdesigns.com within 30 days from the purchase date,
• Provide a valid original proof of purchase (invoice, sales receipt, or personalized order confirmation).

⚠️ Warning: Failure to register the product within this period will make it ineligible for the Commercial Warranty.

1. Routine maintenance and replacement of Products due to normal wear and tear;
2. Damage or defects resulting from use, operation, or handling of the Product inconsistent with normal personal or private use;
3. Damage or modifications caused by misuse, including handling resulting in physical, aesthetic, or superficial damage or alteration of the Product; use of the Product for purposes other than those intended; failure to follow the operating instructions supplied with the Product; maintenance not carried out in accordance with the Product instructions; or use of the Product contrary to the technical or safety standards and regulations applicable in the country of use;
4. Damage or modifications resulting from:
   • Use of the Product with accessories, peripherals, or other products whose type, condition, or standards do not comply with PORT CONNECT specifications;
   • Repairs carried out or attempted by persons not authorized by PORT CONNECT;
   • Modifications or adaptations performed without PORT CONNECT's prior written approval;
   • Negligence;
   • Accidents, fire, liquids, chemicals, other substances, flooding, vibration, excessive or insufficient heat, radiation, electrostatic discharge including lightning, or any other external forces and effects;
   • Failure to maintain the Product;
   • Defects occurring during transportation to or from the Buyer;
5. Products whose serial number has been altered or removed;
6. Defects resulting from failure to comply with the Product's specified power supply requirements;
7. Non-authentic Products.

• Request replacement of the Product from the seller under the statutory warranties (warranty of conformity or warranty against hidden defects);
• Request replacement directly from PORT EUROPE under the Commercial Warranty.

💡 Recommendation: If the defective Product was purchased directly from PORT EUROPE, PORT EUROPE is bound by both the statutory warranties and the Commercial Warranty toward the Buyer. In such circumstances, the Buyer is advised to rely primarily on the statutory warranties, whose conditions are generally more favorable, particularly with regard to the seller covering all shipping costs.

⚠️ Exclusion of Liability: PORT EUROPE shall under no circumstances be held liable for indirect or consequential damages, including:

Article L217-4 of the French Consumer Code:

Goods conform to the contract if, where applicable, they meet the following criteria:

1. They correspond to the description, type, quantity, and quality, including functionality, compatibility, interoperability, or any other characteristic provided for in the contract;
2. They are fit for any specific purpose sought by the consumer and made known to the seller no later than the conclusion of the contract, which the seller has accepted;
3. They are delivered with all accessories and installation instructions required under the contract;
4. They are updated in accordance with the contract.

Article L217-5 of the French Consumer Code:

I. In addition to contractual conformity criteria, goods are deemed compliant if they satisfy the criteria normally expected of goods of the same type, including durability, functionality, compatibility, safety, accessories, updates, and characteristics reasonably expected by consumers.

II. However, the seller shall not be bound by public statements if they can demonstrate that:

1. The seller was unaware of such statements and could not reasonably have been aware of them;
2. The statements had been corrected before the contract was concluded;
3. The statements could not have influenced the purchase decision.

III. The consumer may not rely on a lack of conformity regarding specific characteristics of the goods if they were expressly informed of such deviation and expressly accepted it at the time of purchase.

These provisions govern the consumer's rights regarding remedies, replacement, refund, contract termination, and hidden defects.

📞 Mediation: Failing an amicable agreement, the consumer may refer the matter free of charge to the consumer mediator responsible for the professional, namely the Association of European Mediators (AME CONSO), within one year from the written complaint sent to the professional.
