The commercial warranty offered free of charge by PORT CONNECT (hereinafter the “Commercial Warranty”), applicable to any purchase of its GaN Power Supply products benefiting from the “lifetime warranty,” is provided in addition to — and not as a replacement for — the statutory warranties of conformity (Articles L. 217-3 to L. 217-17 of the French Consumer Code) and hidden defects (Articles 1641 to 1649 of the French Civil Code), for the entire duration of their validity. Accordingly, the Commercial Warranty applies without prejudice to the consumer’s right to enforce the statutory warranty of conformity as well as the warranty against hidden defects.
These provisions apply exclusively to the Commercial Warranty offered by PORT CONNECT and have no impact on the terms of application of the statutory warranties, as defined in the general terms and conditions of sale of the seller (PORT EUROPE or one of its authorized resellers).
1. Description of the Commercial Warranty
For PORT CONNECT GaN Products benefiting from the “lifetime warranty”: the Commercial Warranty covers any material or manufacturing defect affecting the Products, within the framework of normal use and in accordance with the instructions in the user manual. Accessories, cables, and adapters are excluded from this warranty.
Within this Commercial Warranty, PORT CONNECT’s sole obligation is to replace any Product returned by the Purchaser that presents a proven material or manufacturing defect. If replacement proves impossible or unavailable under reasonable conditions, PORT CONNECT will refund the defective Product concerned.
Subject to the conditions set forth herein, the Commercial Warranty is granted to any individual purchaser not acting within the scope of a professional or commercial activity (hereinafter the “Purchaser”).
This Commercial Warranty is personal and requires prior registration on the PORT DESIGNS website, under the conditions defined in section 5 below.
The Commercial Warranty applies exclusively to new Products benefiting from the “lifetime warranty” purchased from PORT EUROPE or one of its authorized resellers or retailers. Products whose labels or identification numbers have been removed or altered
by resellers are deemed unauthorized. Likewise, Products acquired from unauthorized resellers are considered unauthorized. No Commercial Warranty can be granted for such Products, as their authenticity cannot be verified.
2. Territorial Scope of the Commercial Warranty
This Commercial Warranty applies only within the territory of the European Union for a Product purchased and used in an EU member state. French overseas departments and territories (DROM-COM) are expressly excluded from the scope of this warranty.
No request for support or application of the commercial warranty can be accepted for a product that has been purchased, delivered, or used outside the territory of continental Europe.
3. Duration of the Commercial Warranty
The Commercial Warranty applicable to PORT CONNECT GaN Products benefiting from the “lifetime warranty” is valid for life, i.e., for the Purchaser’s lifetime, if the device for which the Product is intended continues to be marketed by its manufacturer.
If the marketing of this device ceases, the Commercial Warranty shall remain active for a period of three years from the date the product was withdrawn from the market.
4. Limitation of the Commercial Warranty Implementation
The implementation of the Commercial Warranty, for all PORT CONNECT GaN Products benefiting from the “lifetime warranty,” is limited to once per calendar year at most, with no carryover from one year to the next if the warranty is not used.
5. Activation of the Commercial Warranty
To benefit from this warranty, you must:
• Create an account and register your product on the website http://www.portdesigns.com within 30 days of the purchase date,
• Provide original and valid proof of purchase (invoice, receipt, or nominative order confirmation).
Failure to register within this period will result in the product being ineligible for the Commercial Warranty.
6. Implementation of the Commercial Warranty
Throughout the duration of the Commercial Warranty, the Purchaser may request its application by logging into their account at https://portdesigns.com and following the indicated procedure.
Once the request has been submitted, a confirmation email will be sent to the Purchaser.
Within 30 days of the request submission, PORT EUROPE will inform the Purchaser by email of its decision regarding coverage under the Commercial Warranty. In case of approval, detailed instructions will be provided.
Shipping costs for the Product are borne by the Purchaser. It is recommended to return the Product by tracked or registered mail and keep proof of shipment.
Upon receipt of the returned Product, PORT EUROPE will, within ten days and at its own expense, ship a replacement Product to the Purchaser.
7. Exclusions from the Commercial Warranty
This Commercial Warranty does not cover the following:
1. Periodic maintenance and product replacement due to normal wear and tears.
2. Damage or defects resulting from use, operation, or handling of the Product not consistent with normal personal or private use.
3. Damage or modifications caused by misuse, including physical, aesthetic, or superficial deterioration of the Product, use not in line with its intended purpose or instructions, improper maintenance, or use not in compliance with technical or safety standards in the country of use.
4. Damage or modifications caused by: o Use with accessories, peripherals, or other products not meeting PORT CONNECT specifications.
o Repairs carried out or attempted by unauthorized persons.
o Modifications or adaptations without prior written consent of PORT CONNECT, including upgrades beyond the specifications in the user manual, or alterations to meet national/local technical or safety standards outside the countries for which the Product was originally designed.
o Negligence;
o Accidents, fire, liquids, chemicals, flooding, vibrations, excessive or inadequate heat, radiation, electrostatic discharges (including lightning), or other external forces.
o Lack of maintenance ;
o Defects occurring during transport to or from the Purchaser.
5. Products with altered or missing serial numbers.
6. Defects due to non-compliance with the Product’s main power supply requirements.
7. Non-genuine Products.
8. Relationship Between Statutory Warranties and the Commercial Warranty
The Commercial Warranty offered by PORT CONNECT allows the Purchaser to obtain a replacement for a defective Product, just as statutory warranties allow.
If the defective Product was purchased from an authorized PORT CONNECT reseller or retailer, the Purchaser has two options:
• Request replacement from the seller under statutory warranties (conformity or hidden defects),
• Request replacement directly from PORT EUROPE under the Commercial Warranty.
If the defective Product was purchased directly from PORT EUROPE, the company is bound by both statutory warranties and the Commercial Warranty.
In this case, it is recommended that the Purchaser first rely on the statutory warranties, as their conditions are generally more favorable, particularly regarding full coverage of shipping costs by the seller.
9. Limitation of Liability
Under this Commercial Warranty, and subject to compliance with the above conditions, PORT EUROPE undertakes only to replace the Product with an identical or equivalent model in terms of functionality. If this is not possible, a refund of the purchase price may be offered.
PORT EUROPE shall in no event be held liable for indirect or intangible damages, such as:
• Loss or damage related to the Product,
• Financial losses, lost profits, revenues, or data,
• Loss of use of the Product or any associated product,
• Any incidental or indirect damage.
10. Consumer Rights
As part of this Commercial Warranty, and subject to compliance with the implementation conditions previously described, PORT EUROPE undertakes only to replace the Product with an identical model or one equivalent in terms of functionality. If neither of these solutions can be applied, a refund of the purchase price may be offered to the Buyer.
However, PORT EUROPE shall in no event be held liable for indirect or intangible damages, such as:
• Losses or deterioration related to the Product,
• Financial losses, loss of profit, revenue, or data,
• Loss of enjoyment or use of the Product or any associated product,
• Any other incidental or indirect damage.
11. Disputes
In case of difficulties in applying these general conditions, the Purchaser may, prior to any legal action, refer the matter to the Consumer Mediator.
In the event of a dispute between the professional and the consumer, they will endeavor to reach an amicable settlement.
Failing an amicable agreement, the consumer may refer to the matter free of charge to the competent Consumer Mediator, namely the Association des Médiateurs Européens (AME CONSO), within one year of the written complaint sent to the professional.
Referral to the Consumer Mediator may be made:
• By completing the online form on the AME CONSO website: mediationconso-ame.com,
• By mail addressed to AME CONSO, 197 Boulevard Saint-Germain - 75007 PARIS.
It is recalled that seeking an amicable solution does not suspend the duration of the statutory warranty nor that of the Commercial Warranty.
In the event of a dispute relating to these general terms, failing amicable settlement or if the parties do not wish to use mediation, only the French courts shall have jurisdiction.
12. Personal Data
The Purchaser’s personal data collected under the Commercial Warranty are processed electronically to enable PORT EUROPE and, where applicable, its service providers, to ensure proper performance of the associated services. Subject to the Purchaser’s consent, such data may also be used to send information and promotional offers by email.
They may also be used to inform the Purchaser by post of brand news, the products they have purchased, or to propose a warranty extension approaching expiry.
Data are retained for the period strictly necessary for after-sales service management, unless a longer retention period is required or permitted by law or regulation.
